Terms of Service

Effective Date: 6-1-2016 

These Terms of Service ("Agreement") are entered into by and between Apex Mechanical, LLC, a Missouri company, located at 4009 South Limit Ave, Sedalia, MO ("Company", "we", "our", or "us"), and the customer ("Customer", "you", or "your"). By requesting or using our heating, ventilation, and air conditioning (HVAC) services, you agree to be bound by this Agreement. 

  1. Services Provided

We offer a range of HVAC services including, but not limited to: 

  • Installation, maintenance, and repair of heating and cooling systems
  • Air duct cleaning and inspection
  • Thermostat installation and programming
  • Emergency HVAC services

All services are performed by certified and trained technicians. 

  1. Estimates and Pricing
  • Written estimates will be provided upon request prior to beginning any work.
  • All prices are subject to applicable taxes and fees.
  • Estimates are valid for 30 days from the date issued unless otherwise specified.
  1. Scheduling and Cancellations
  • Appointments may be scheduled via phone, email, or our website.
  • A minimum of 24 hours’ notice is required for cancellations. Cancellations made less than 24 hours in advance may incur a service charge.
  1. Payment Terms
  • Payment is due upon completion of services unless otherwise agreed in writing.
  • We accept cash, checks, and major credit cards.
  • Unpaid balances may accrue interest and may result in suspension of further service. 
  • The customer agrees to be responsible for all reasonable costs associated with the collection of any unpaid amount, including but not limited to attorney’s fees, court costs, and other legal expenses.
  1. Warranties and Guarantees
  • We guarantee the quality of our labor for a period of 1 year after installation.
  • Manufacturer warranties apply for all new equipment installed, subject to their terms.
  • Warranty does not cover damage due to misuse, neglect, acts of God, or unauthorized repairs.
  1. Customer Responsibilities
  • Customers must ensure clear access to the service area.
  • Customers are responsible for securing pets, valuables, and fragile items.
  • Customers must disclose any known issues with HVAC systems prior to service.
  1. Limitation of Liability

We are not liable for: 

  • Pre-existing conditions or damages not caused by our service
  • Delays due to weather, supply chain issues, or factors beyond our control
  • Indirect, incidental, or consequential damages
  1. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your breach of this Agreement or misuse of our services. 

  1. Governing Law

This Agreement shall be governed by the laws of the State of Missouri, without regard to its conflict of law principles. 

  1. Amendments

We reserve the right to modify these Terms of Service at any time. Updated versions will be posted on our website with the effective date.
